What Potential Lien Law Updates Could Mean for Alabama Storage Operators

Alabama last updated its Self-Service Storage Act in 2021, introducing several improvements to the lien process for storage operators.

Those updates allowed operators to use verified mail instead of certified mail, clarified the ability to send notices by email when authorized in the lease, permitted online auctions of delinquent storage units, and allowed vehicles, trailers, and watercraft to be towed after 60 days of unpaid rent.

The next legislative effort being discussed focuses on modernizing lien sale advertising requirements.

Currently, Alabama operators are generally required to advertise lien sales in a newspaper prior to conducting a sale. While this requirement historically ensured public notice, the industry has increasingly shifted to online auction platforms where most bidders now find storage auctions.

Proposed legislative updates could allow operators to advertise lien sales through digital platforms and online marketplaces.

For storage operators, these updates could provide several benefits:

• Reduced advertising costs
• Greater visibility for lien sales
• Increased bidder participation
• A more efficient lien sale process

Importantly, the goal of these updates is to maintain transparency and public notice requirements while allowing operators to place notices where potential bidders and customers are most likely to see them.
